The Plenary Session of the Congress of the Republic approved the bill that prohibits judges and prosecutors from ordering and requesting preliminary arrest and preventive detention against police officers who use their firearm in an intervention. Likewise, the proposal states that if the police officer “uses his weapons or means of defense in a regulatory manner and as a consequence, an injury or death occurs” he will not be able to be detained.
The legislative initiative, which seeks to guarantee the principle of presumption of innocence and provide greater protection to people from National Police of Peru (PNP)was approved with 95 votes in favor and, in turn, exempted from the second vote with 80 votes in favor, 18 against and 3 abstentions. Both the benches of Popular Force and Free Peru supported legislative projects 3999/2022-CR, 7115/2023-CR and 7965/2023-CR, which proposes to modify the Penal Code, Legislative Decree 635 and the New Criminal Procedure Code, Legislative Decree 957.
“The prosecutor is prevented from requesting preliminary judicial detention against the personnel of the National Police of Peru in a situation of activity in cadres who, in the exercise of their constitutional purpose, use their weapons or means of defense in a regulatory manner. and, as a consequence, some injury or death occurs,” the document reads.
They seek that only the military jurisdiction can judge the Police and the Armed Forces
Likewise, the law includes that “those over eighty years of age, for humanitarian reasons, will face their sentence in accordance with the scope of article 288 or 290 of the New Code of Criminal Procedure, Legislative Decree 957.” That is, that person could not go to prison if he or she is over 65 years old or suffers from a serious or incurable illness.
