Congress requires toxicological examination for category A and B drivers

Fux claims to maintain a number of deputies in the 2026 elections

The National Congress maintained three presidential vetoes in full and overturned only one after an agreement between the government and opposition this Thursday (4). In a fifth veto analyzed, deputies and senators maintained one and rejected three of the vetoed devices. Congress requires toxicological examination for category A and B drivers

The vetoes were included as an extra agenda during a session scheduled exclusively to consider the Budget Guidelines Law (LDO) of 2026.

By rejecting one of the vetoes, Parliament established the obligation of a toxicological test for the first license of drivers in categories A and B of the National Driving License (CNH).

Categories A and B are intended for drivers of cars, vans and passenger motorcycles. Until then, the toxicological test was only required for drivers in categories C and D, which are those who transport cargo or passengers.

With the overturn of this veto, all types of drivers must present a negative toxicological test to acquire their first driver’s license. In the case of drivers in categories C and D, the exam is also required when renewing their license.

The overturned veto was applied in the sanction of Law 15,153 of 2025, which intended the use of traffic fines to finance the National Driving License (CNH) of low-income people registered in the federal government’s Single Registry.

People with disabilities

One of President Luiz Inácio Lula da Silva’s vetoes maintained by Parliament This was what barred the provision that limited the granting of the Continuous Payment Benefit (BPC) only in cases of disability considered moderate or severe. The BPC is paid to low-income elderly people or people with disabilities in situations of poverty.

With the maintenance of the veto, it is also possible to grant the BPC to people with disabilities considered mild. The veto was related to Law 15,077 of 2024, which changes rules linked to social assistance, pensions and income transfer programs.

Pedophiles and sexual predators

Also by agreement, the Executive’s veto was maintained, which overturned the provision that provided that the data of those convicted in the National Registry of Pedophiles and Sexual Predators would be available for public consultation for 10 years after serving their sentence.

With the maintenance of the veto, the list of those convicted of sexual crimes remains open for the duration of their sentence. The veto maintained refers to Law 15,035.

Embrapa

Also by agreement, the full presidential veto of the bill that exempted the Brazilian Agricultural Research Corporation (Embrapa) from paying fees and contributions charged by regulatory bodies in requests made by the state-owned company was rejected.

The government claimed in its veto that the measure provided tax benefits without presenting compensatory measures with a budgetary impact, affecting the financial balance of regulatory entities.

On the other hand, project supporters argue that the measure facilitates innovation in the agricultural sector by reducing Embrapa’s costs. With the veto overturned, the exemption from paying fees will be sanctioned into Law.
