In accordance with what was advanced in the first term in terms of confrontation, the Congress still has a series of bills and constitutional reforms on the agenda whose purpose is to continue attacking President Pedro Castillo and further affect the principle of the balance of powers between the Executive and Parliament.
This agenda becomes clearer in the projects that have already been approved and those that are on the agenda in the Constitution Commission, chaired by the parliamentarian of Fuerza Popular Patricia Juárez.
On the other hand, This working group keeps in the freezer the constitutional reform project presented in October 2021 by the Executive Power, with Mirtha Vásquez at the head of the Council of Ministers, with the purpose of generating a better regulation on the balance of powers.

Accuse Castillo
A first group of bills seeks to open the options so that President Pedro Castillo can be investigated by the Public Ministry and even accused, during the performance of their duties.
This, seen in context, is related to the objective maintained by several congressional benches to remove Castillo from office, after not recognizing the results of the elections.
Thus, for example, an authentic interpretation project formulated by Acción Popular (1249) is on the agenda. The initiative entered Congress on March 2 and the author is Luis Aragon. The parliamentarian from Cusco proposes to make clarifications on article 117 of the Constitution, establishing that the constitutional bodies or powers of the State can carry out investigations in order to determine criminal or civil responsibilities on the part of the president.

But it is not the only proposal. On January 26, Patricia Chirinos (Avanza País) presented a reform project (1204), to modify article 117 of the Constitution. What does it raise? That the president can be accused during his term of office for crimes such as corruption, drug trafficking or human rights violations.
From the same bench Norma Yarrow processed project 1154 on January 17, under the constitutional development formula of article 117, specifying that the president can be the object of investigation during his government period.
As well the purple party He presented the reform initiative 918, so that the president can be accused of crimes related to corruption.

All this block of proposals is aimed solely at the president Castillo, who, moreover, is the target of serious accusations for alleged acts of corruption.
The projects of the Congress, however, show a contrast with the lack of initiatives in relation to the performance of parliamentarians. Without going too far, there is a project (558) that proposes to modify the composition of the Ethics Commission with members from outside Parliament to avoid shielding. The text is kept in the freezer.
The balance of powers
Parliament is also awaiting approval of the constitutional reform promoted by Patricia Juárez to eliminate the mandatory vote of confidence, when a new cabinet assumes.

On November 3, Juárez presented this project (612) so that the Executive can no longer use the denial of the vote of confidence to a new cabinet as the first crisis, in order to move towards the closure of Congress (in the event of a second refusal).
Juárez approved the opinion of his project on February 15 of this year and the only thing missing is a vote in Congress.
If this opinion has not yet entered the Plenary for debate, it is not because Parliament wants to create space and time for reflection. The reason is another: The Fujimorist bloc and the like are not guaranteed the 87 votes to approve this constitutional reform.

The eventual approval of this isolated reform it would mean a further weakening of the principle of balance of powers. This is due to the fact that Congress has already approved regulations that establish limits to the application of the matter of trust by the Executive.
charges of trust
Another aspect that has received special attention from Congress is the appointment of ministers and other positions of trust in the Executive.
Yes OK Castillo looked at the autograph, the Constitution Commission decided to go by the insistence of some extremes of the norm. Reforms against the country and citizenship
Since the beginning of the current administration, the main objective of the legislators has been to break the balance of powers regulated in the Constitution.
Thus, they established parameters for the application of the question of trust, despite the fact that the Constitution does not establish limits.
They also regulated interpretations for prevent citizens from fully exercising the right to citizen participation.
