The Ungrouped Congressman Edward Malaga presented with 67 signatures the third vacancy motion against President Pedro Castillo for an alleged moral incapacity. Implying that he has the necessary votes, he said that “I would not have presented it if I were not sure that it will be approved.”
Despite the fact that the motion only has 67 signatures from congressmen from AP, APP, Renovación Popular, Fuerza Popular, Avanza País and Somos Perú, Málaga assured that “today we have a number that easily exceeds 87 votes” and recalled that some members of Congress who have not signed the motion have promised to vote for the vacancy.
According to the legislator, the “eventual closure of the Congress“It has been the reason for some parliamentarians to join in favor of the vacancy motion, “it is the trigger,” he noted.
Without specifying who it is, assured that there are official congressmen who have contemplated the vacancy as a possibility“realizing that the castle management it has exceeded its tolerance level”; but she did not rule out that “they back down, that someone buys them, offers them a ministry. Nothing can guarantee the final number of votes.
The arguments
Malaga divides the accusations against the president into four. It begins with “the takeover and dismantling of the state through the appointment of high officials”, questioning the appointment of former ministers Guido Bellido, Juan Silva, Geiner Alvarado, among others.
It is also based on the tax investigations against President Castillo, who is accused of being the leader of a criminal network in the Government.
As a third part, it alludes to acts qualified as “direct manifestations of the president’s immorality, such as academic plagiarism and personal concealment. Finally, he says that there is an alleged government recruitment of congressmen in exchange for quotas of power.
For the constitutionalist Omar Cairo, it is a motion that has no support for a vacancy due to moral incapacity. He added that it cannot be considered that a president is obliged to have a certain moral behavior, because there is no obligatory moral system for Peruvians.
For the former Ombudsman Walter Albán, “there is grounds for a moral incapacity, but there are not 87 votes.”
Last night in the Plenary of Congress was informed of the vacancy motion and the head of Congress, José Williams, reported that President Castillo had already been notified. What is coming is that in tomorrow’s plenary session, at 6 pm, the admission of the vacancy request will be submitted for debate and subsequent vote, for which 52 votes are needed.
If this stage is overcome, President Pedro Castillo will be summoned to give his defenses in plenary session on Monday. Then, the vacancy is put to a vote in plenary session and that is where the 87 votes are required to finalize the departure of the first president.
Faced with the request for a vacancy, the AP spokesman, Elvis Vergara, and the leftist benches yesterday they presented a motion to create a special commission “for governance” between the Executive and the Legislative.
reactions
Omar Cairo, constitutionalist
“In the motion there is a list of facts that could be crimes, but the vacancy for moral incapacity is not a mechanism to punish the president for any of these conducts.
Walter Albán, former Ombudsman
“We are increasingly trapped and it is clumsy to believe that 87 votes can be reached, while the president knows that he cannot dissolve Congress without breaking the pact with Cerrón”.
Motion is already pending
Congressmen from AP, APP, Renovación Popular, Fuerza Popular, Avanza País and Somos Perú signed a new vacancy request against Castillo.
