Congress formalizes delegation of powers to the Executive in citizen security

He Congress of the Republic made official Law No. 32527, published this Monday in the official newspaper El Peruano, through which the Executive power the power to legislate for a period of 60 calendar days on citizen security and the fight against organized crime, responsible economic growth and institutional strengthening.

Citizen security

In the area of ​​citizen security, the Executive may issue 24 regulations aimed at reinforcing the government’s policy against crime.

Among the planned measures is the modification of the Penal Code to criminalize the illegal shared possession of firearms in cases of criminal attempt or flagrante delicto.

Likewise, rules are contemplated to prevent the misuse of refugee status by foreigners in an irregular situation. Reforms to the criminal and procedural framework applicable to illegal mining are also considered, as well as the incorporation of the crime of revealing confidential information in criminal investigations and police actions.

Finally, the increase in penalties for resistance or disobedience to authority is allowed, in order to strengthen the principle of authority.

Economy

Regarding economic growth, the Executive is empowered to dictate 17 regulations in this field, among them are the modification of the Payment System for Tax Obligations with the Central Government, applicable to enforceable debt.

Likewise, reforms to the Criminal Tax Law are contemplated to sanction new forms of tax fraud, as well as the creation of a special value control procedure in the customs import regime for consumption.

On the other hand, the General Customs Law will be modified to allow the carrier to replace the confiscation penalty with a fine in cases of undeclared goods in transit or transshipment.

Institutional strengthening

Finally, the government may issue seven regulations within the framework of institutional strengthening, among which is the reform of the General Agrarian Health Law to incorporate provisions on the protection and well-being of domestic animals.

The law establishes that each minister must report in writing to the Constitution and Regulations Commission of Congress about the progress in the implementation of the legislative measures, within the period of 60 days of validity of the delegation.
