The National Congress extended for another 60 days the validity of the Provisional Measure (MP) 1117/22 who changed the rule for updating the table of minimum floor price for road freight. the act was published today (11) on Official Diary of the Union.
The provisional measure is valid for 60 days, extendable for another 60 days. If it is not voted on within 45 days, it enters an emergency regime and locks the agenda of the legislative house in which it is being processed. If, at the end of the period, the MP is not voted on, it loses its validity.
The MP changed the percentage of variation in the price of diesel to correct the values of the minimum freight floor table, from 10% to 5%. In summary, the text of the MP defines that whenever there is a variation in the price of diesel by more than 5%, the table must be updated.
Created in 2018, after the truck drivers strikethe legislation on the National Policy on Minimum Floors for Road Cargo Transport establishes that the National Land Transport Agency (ANTT) must publish the table every six months, until January 20 and July 20 of each year, with the values will be valid from the floor for the semester.
The original text also provided that the table must be updated whenever there is an oscillation in the price of the product equal to or greater than 10%, up or down. With the change introduced by the MP, this percentage was reduced to 5%.
Now, whenever there is an oscillation in the price of diesel oil in the domestic market greater than 5% in relation to the price considered in the calculation spreadsheet, ANTT must update the table.
When publishing the MP, the federal government justified the decision with the argument that the change aimed to provide sustainability to the road freight transport sector, especially to self-employed truck drivers, “in order to provide a fair remuneration compatible with the costs of the activity “.
For the preparation of the table, in addition to the price of the product, the number of kilometers traveled in carrying out freights, loaded axle, considering the distances and specificities of the defined loads, as well as the calculation spreadsheet used to obtain the respective floors minimums.
On June 24, the National Land Transport Agency (ANTT) released the new minimum freight floor table, with an average readjustment of 7.06% to 8.99%.
The last adjustment in the price of diesel was announced by Petrobras on June 17th. On the occasion, the company readjusted by 14.2% the price of diesel.
The readjustment took place two days after the Chamber of Deputies have completed voting of the Complementary Law Project (PLP) 18/2022, which limits the application of the Tax on the Circulation of Goods and Services (ICMS) on fuels.
The project provides for the incidence of the ICMS rate for natural gas, electricity, communications and public transport, products classified as essential and indispensable, leading to the fixing of the ICMS rate at a maximum level of 17% or 18% (depending on the location ), lower than that currently practiced by states. The PLP also provides for the Union’s compensation for state revenue losses when the revenue loss exceeds 5%.
The text also reduces to zero, until December 31, 2022, the Cide-Fuel rates and the taxation of the Social Integration Program (PIS) and Contribution to the Financing of Social Security (Cofins) levied on gasoline. Diesel and cooking gas already have these taxes zeroed.
