After the approval of the Budget Guidelines Bill (LDO), the National Congress enters next week close to the final stretch of its activities this year. On Tuesday (9) there will be a solemn session for the promulgation of the proposed Amendment to the Constitution (PEC) that grants immunity from Motor Vehicle Ownership Tax (IPVA) to vehicles aged 20 years or more.
On Tuesday (9), a solemn session of the National Congress is scheduled to enact PEC 72/23, which grants exemption from IPVA for vehicles manufactured 20 years or more. The proposal standardizes national legislation to extend the benefit of tax immunity, which already exists in some states, to the entire country, mainly benefiting the low-income population who own old cars.
A meeting is scheduled to be held in the Chamber of Deputies to present the opinion of deputy Mendonça Filho (União-PE) on PEC 18/25 on Public Security. Initially the opinion should have been presented to party leaders last week, but, according to the rapporteur, the postponement served to more conversations with the leaders, in order to understand the “feeling of the House” regarding the proposal.
The rapporteur, however, has already advanced some points of his opinion. Among them is the inclusion of a device to limit the publication of acts by the National Council of Justice (CNJ) that reach the prerogatives of Congress in the formulation of rules related to public security. He also cited the change in the proposal to create the National Public Security Council (CNSP), a collegiate body of the Ministry of Justice that brings together authorities and civil society institutions to formulate and propose public policies focused on preventing and repressing crime. In his opinion, the council will no longer be deliberative and will become consultative.
There are no plans for ordinary deliberative sessions in the Chamber plenary, but there will be debates and votes in permanent and special committees. The Constitution and Justice Commission (CCJ) is expected to present the opinion of deputy Danilo Forte (União-CE) for Bill (PL) 2531/21 that creates the national salary floor for basic education professionals who are not teachers. The proposal establishes the minimum wage for these workers at 75% of the amount paid to teachers. The measure covers employees such as administration assistants, school secretaries, cooks, student inspectors, doormen and general service assistants.
Among the votes in the special committees is the opinion of deputy Moses Rodrigues (União-CE) on Bill (PL) 2614/24, which approves the National Education Plan for the 2024-2034 decade.
It is also planned to vote on the report by deputy Augusto Coutinho (Republicanos-PE) on Complementary Bill (PLP) 152/25 which regulates the services of individual private paid passenger transport applications and the collection and delivery of goods.
Among other points, the proposal regulates the minimum working hours, the minimum time connected to the application or digital platform, the mandatory minimum availability, in addition to the need to conclude a written contract that regulates the working relationship between app drivers and delivery people and the platforms.
Another highlight is the discussion of the Banco Master scandal. The bank’s president, Daniel Bueno Vorcaro, was arrested, and later released, accused of fraud in operations in the financial market that could total R$12 billion, according to the Federal Police (PF).
A joint hearing of the Finance and Taxation committees is scheduled for Tuesday; Pensions, Assisi. Social, Childhood, Adolescence and Family to debate the Banco Master scandal and its relationship with Rioprevidência, with the participation of directors of the institution, state deputies, councilors and representatives of the Court of Auditors of Rio de Janeiro, as well as representatives of the Central Bank (BC) and the Ministry of Finance.
The Consumer Protection Commission will debate the consequences of the extrajudicial liquidation of Banco Master on the same day. The presence of the president of the Central Bank, Gabriel Galípolo, is expected; the president of the Bank of Brasília (BRB) Celso Eloi Cavalhero; of representatives from the Administrative Council for Economic Defense (Cade), the Securities and Exchange Commission (CVM), the Brazilian Federation of Banks (Febraban) and Banco Master.
Ethics Council
Still on Tuesday, a meeting of the Ethics Council is scheduled to hear the representation witnesses against deputies Marcos Pollon (PL-RS), Marcel Van Hattem (Novo-RS) and Zé Trovão (PL-SC). Also on the agenda is the vote on the report by deputy Fernando Rodolfo (PL-PE) in the case filed by the Novo party against deputy Lindbergh Farias (PT-RJ).
On Thursday (10), the hearing of witnesses in the case against deputy Marcos Pollon (PL-RS) continues.
Senate
In the senate, the expectation revolves around the discussion and possibility of voting on the controversial PEC 48/23 which amends paragraph 1 of article 231 of the Federal Constitution (CF), in order to establish as a time frame for the recognition of traditional indigenous occupation the date of promulgation of the Constitution, that is, October 5, 1988. The text’s rapporteur at the Senate’s CCJ, Esperidião Amin (Progressistas-SC) presented a favorable opinion to the change.
The vote on the proposal was announced last Wednesday (3) by the president of the Senate, Davi Alcolumbre (União-AP) as a reaction to the monocratic decision of the minister of the Federal Supreme Court (STF) Gilmar Mendes, that only the head of the Attorney General’s Office (PGR) is able to report ministers of the Court to the Senate for crimes of responsibility.
The matter is subject to trial in the STF, scheduled to begin in December 5th and has Mendes as rapporteur.
Discussion of PEC 169/19 is also planned, which amends article 7 of the Constitution to allow the paid accumulation of the teaching position with another position of any nature.. The proposal has a favorable opinion from the CCJ rapporteur, Zequinha Marinho (Podemos-PA).
Another notable vote is the urgency for the analysis of PLP 143/20, which amends Complementary Law 173/20, to provide for the authorization of retroactive payments of annual, three-year, five-year, sixth-part, bonus leave and other equivalent mechanisms to public servants of federative entities that have declared a state of public calamity resulting from the Covid-19 pandemic.
In the Parliamentary Commission of Inquiry (CPI) that investigates organized crime, the testimony of the Minister of Justice and Public Security, Ricardo Lewandowski, is scheduled. He will talk about the government’s initiatives to tackle the problem.
On Wednesday (10), the Minister of Environment and Climate Change, Marina Silva, is expected to be present at the Agriculture and Agrarian Reform Commission (CRA) to provide information on the draft resolution of the National Biodiversity Commission (Conabio), which proposes the publication of national lists of invasive exotic species. The minister, however, has not yet confirmed the presence.
The collegiate also meets on the same day to deliberate on the report by senator Jaime Bagattoli (PL-RO) evaluating the National Agrarian Reform Program and the National Agrarian Reform Policy (PNRA).
