Congress approves in second vote that the PNP investigate crimes in the preliminary phase

With 80 votes in favor, 31 against and 6 abstentions, the Plenary of the Congress of the Republic approved in the second instance a reform which proposes to modify 33 articles of the Criminal Procedure Code, in order to empower the National Police to investigate crimes.

This new regulation will grant the Peruvian National Police (PNP) greater powers to lead preliminary investigations into crimes in order to “speed up criminal proceedings.”

The reform, promoted by the Justice and Defense Commissions, has generated controversy among those who believe that it will reduce the powers of the Public Prosecutor’s Office.

Proponents of the measure argue that it will allow the police to act more efficiently and quickly in investigating crimes, avoiding delays that could compromise justice.

However, the Prosecutor’s Office considered that the rule is unconstitutional because it directly contravenes its functions.

As is known, Congress had already approved the reform in a first vote on August 22, with 72 votes in favor, 29 against and 4 abstentions, but it had to be ratified in a second vote by the Plenary of Congress within a period of no more than seven days.
