Congress approves a rule that would favor it in a jurisdictional lawsuit against the Judiciary

With the support of 72 votes, the Plenary of the Congress approved, in a second vote, the opinion that lowers from 5 to 4 the number of votes necessary for the Constitutional Court (TC) declares the inadmissibility of a jurisdictional claim.

The decision, which had 20 legislators vote against and eight abstentions, occurs precisely at a time when the Constitutional Court is pending a ruling on a jurisdictional claim raised by Parliament against the Judiciary for temporarily revoking the disqualification of Inés Tello and Aldo Vásquez as members of the National Board of Justice (JNJ).

According to the approved text, “in jurisdictional processes, the sentence is obtained with the affirmative vote of four magistrates. In the event of a tie, the president of the Constitutional Court has the deciding vote. If the required number of votes is not reached, the claim will be deemed unfounded.”

He President of the Constitution Commission, Fernando Rospigliosi, maintained that the measure reinforces the protection of fundamental rights in harmony with the Constitution.

Congressman Jaime Quito, however, spoke out against the measure and denounced that with this ruling Congress will have control of the Constitutional Court. “This violates the balance of powers, we cannot continue to accept that the rule of law and institutions continue to be constantly violated,” he said.
