Congress: Approval of the list of members of the Special Commission for the election of magistrates of the TC

The Congress of the Republic approved last Thursday, March 9, the list of members of the Special Commission for the selection of a suitable candidate for the election of a magistrate of the Constitutional Court (TC). The vote on this issue obtained 89 votes in favor, 0 against and no abstentions during the last legislative plenary session.

As prescribed in the third paragraph of article 201 of the Political Constitution of the State, Parliament must continue with the public contest of merits to elect the new members of the TC.

It should be mentioned that article 201 explains that the Constitutional Court is the body that controls the Constitution. He is autonomous and independent. It is made up of seven members elected for five years and details how the process should be.

“To be a member of the Constitutional Court, the same requirements are required as to be a member of the Supreme Court. The members of the Constitutional Court enjoy the same immunity and the same prerogatives as congressmen. They are subject to the same incompatibilities. There is no re-election immediately”, specifies the Magna Carta.

Likewise, the Constitution affirms that the members of the TC are elected by the Legislative Branch through the favorable vote of two thirds of the legal number of its members and that judges or prosecutors who have not left office with one year in advance
