The Comptroller General of the Republic (CGR) warned the National Infrastructure Agency (ANI) and the Public Credit Directorate of the Ministry of Finance, this Monday about an imminent risk of loss of public resources for $225,549 millionin case of termination and liquidation of the concession contract for the construction, rehabilitation, improvement, operation, maintenance and reversal project of the Mulaló – Loboguerrero corridor.
“The sum of $222,549 million may be higher if, after the liquidation, the decision to continue with the work is maintained, since this would mean an extra cost, due to the double payment of its structuring, an activity that is estimated at more than $9,133 million, which means a total loss of $234,683 million”, says the control entity in a statement.

Regarding a possible solution, the Comptroller General, Carlos Rodríguez, pointed out that it is feasible to opt for an agreement, which requires carrying out a adjustment to the economic balance of the contract for a value of $415,000 million in December 2012, which is a lower sum than the one that the State must disburse in a scenario of early termination, which could be more than $684,000 million.
It is worth noting that the ANI is aware that the contract requires an update of at least those $415,000 million.
“Under the constitutional and legal precepts, it is important to ensure compliance with the essential purposes of the State and guarantee the greatest efficiency in the use of public resources, in such a way that a greater damage is not configured that must be assumed by the entity.”, stated Comptroller General Rodríguez.
It should be remembered that this project, which is part of the Fourth Generation tracks, was is suspended in its pre-construction stage, because the parties to the contract dispute.
This situation could lead to the early termination and liquidation of the legal business due to the impacts it produced in its normal execution, which meant that, despite being a 2015 project, it never began its construction stage.
