Comptroller Warns of an “Adverse Situation” in Designation of Attorney General of the State

Attorney General's Office says that "repetitive questions" cannot be asked after silence in Castillo's interrogation

The Comptroller General of the State warns of an “adverse situation” in the process of appointing the Attorney General of State, Maria Caruajulca Quispean official appointed by President Pedro Castillo and former Minister of Justice Ángel Yldefonso after dismiss Daniel Soria Luján.

According to the orientation report, during the process, neither the Ministry of Justice nor the State Attorney General’s Office complied with requiring Caruajulca Quispe to provide a sworn declaration that he had not committed any lack of suitability in the legal defense of the State.

“Despite the fact that she was included in reported facts that involved her and that are being evaluated by bodies that are dependent on her office, situation that gives rise to the risk of affecting the principle of justice and equity; as well as, labor relations in conflict for the fulfillment of functions in charge are maintained, ”warns the report.

Given the omission, the Institutional Control Body of the Ministry of Justice asked the PGE for a detailed report on the complaints in which María Caruajulca is involved. The Functional Control Office of the institution responded that there is a complaint that would implicate the head of the Attorney General’s Office.

This is a complaint against Caruajulca for “inaction in legal defense” and “lack of follow-up and promotion of complaints at the police level.” This was when she was working as a public prosecutor for the Municipality of San Juan de Lurigancho.

According to the Evaluation, Supervision, Control and Audit Unit of the Office of Functional Control, the current prosecutor did not ratify a complaint before the Police Station and did not initiate legal action against an official for alleged falsification of documents.

The Comptroller’s report also warns that the work of the Office of Functional Control — office in charge of evaluating, supervising, controlling, supervising, instructing and sanctioning attorneys in the first instance — could be affected because it depends administratively and functionally of the State Attorney General’s Office.

“The adverse situation (…) makes it possible for the impartiality of the evaluation of these facts to be affected, since they are matters that occurred at the time when the current Attorney General of the State worked as a public attorney for the District Municipality of SJL, causing in turn the risk of affecting the principle of justice and equity; as well as, of maintaining labor relations in conflict with the fulfillment of functions in charge of the PGE and its owner, ”says the document.

Call for action

The control report recommends that the Minister of Justice and Human Rights, Félix Chero, regarding the adverse situation detected in the appointment process of María Caruajulca, “adopt the corresponding preventive and corrective actions.”

In the official letter sent to the head of Justice, Chero is required to report on the action plan to be taken within a period of 10 days after receiving the document.
