The Authority for Consumer Protection and Defense of Competition (Acodeco) received 95 complaints for B/.671,916.85 due to situations presented by the purchase of a used motor vehicle, during the last year.
The main reasons for the complaints presented by the owners of used cars were 62 for breach of warranty, for a total amount of B/. 474,624.39, which is the main reason for the claims; 24 due to lack of information (B/.118,347.67); 4 breaches of contract (B/.53,697.80); 2 for failure to comply with the service (B/.2,911.87); and with a complaint there are deceptive sales (B/.13,395.00), hidden defect (B/.8,300.00) and custody of the property (B/.640.12).
In addition, it should be noted that last year, 54 complaints filed for irregularities in the purchase of used cars were resolved, for a total amount of B/.415,638.16.
Acodeco recommends that buyers verify the physical address of the economic agent; seek advice prior to purchasing the car, with a suitable mechanic or trusted person; perform road tests of the vehicle to be purchased and document the transaction and payments made. It is important to verify the documentation provided, especially everything related to the warranty and vehicle inspections.
Remember to demand the warranty in writing, which for a used vehicle is 6 months or 15 thousand kilometers, whichever comes first. If the guarantee offered is greater, it must also be stated in writing.
In accordance with the provisions of Law 45 of 31 of 2007, it is necessary to emphasize that Acodeco can only address complaints about sales of used cars that are marketed by an economic agent dedicated to this activity, and not in cases of sale by a private person.
