Commission approves secondary laws on Judicial Reform; go to plenary session

In these reforms, the deputies maintained some questioned points, such as giving more power to the president of the National Electoral Institute (INE).

In article 47 of the General Law of Electoral Institutions and Procedures it is mentioned that whoever presides over the General Council of this organization, in this case Guadalupe Taddei, will have the powers to designate the executive directors and other heads of technical units of the Institute. Currently these appointments are put to a vote in the General Council of the INE.

The Justice Commission maintained the “super powers” of the president of the INE, Guadalupe Taddei.

During the discussion, deputy Emilio Suárez Licona questioned what the legal situation was regarding the judicial reforms; That is, if there are suspensions against these secondary laws and they were fought.

“I submitted a request for the Legal Affairs Directorate to inform the Commission about the existence of provisional and definitive suspensions, the effects that these have – if they exist – for the discussion that is taking place today and if the Chamber of Deputies fought the definitive suspensions. It is important, because the principle of democratic liberation requires that all instances and at all stages of the legislative process guarantee information to all legislators,” said the PRI member.

To which the Morenista Leonel Godoy responded that the suspensions of the judges to stop the discussion of the Judicial Reform and its application were “a chicanada” by the Judiciary, since he emphasized that the Amparo Law establishes that he cannot carry out these acts legal arguments against a constitutional reform.

“The Court was preparing a scenario that wanted to take it to its ultimate justification, first they promote suspensions themselves, and they themselves grant them illegally; Second, they themselves promote blockades of the Chamber of Deputies and Senators, and then point out that the legislative process is being violated by not acting on suspensions that were inappropriate,” commented the deputy.

What are the approved secondary laws about?

The deputies began with the General Law of the System of Means of Challenge in Electoral Matters, which establishes when an election of judges of the Judicial Branch of the Federation is annulled. This was approved with 26 votes in favor and 10 against in general and particular.

This modification proposes that during the electoral process for the election of judges of the Judicial Branch of the Federation, the nonconformity trial will proceed to challenge the determinations of the federal electoral authorities that violate constitutional or legal norms.

It mentions that when the election of judging persons of the Judicial Branch of the Federation is challenged, the respective judgment of disagreement must be presented by the interested candidate.

It also specifies that the demand for the nonconformity trial must be presented within four days from the day after the completion of the district calculations for the election of ministers of the SCJN, as well as magistrates of the Superior Chamber of the Court.
