For COFE, the new system of medical certifications constitutes a “salary reduction” and even assures that constitutional lawyers have affirmed that both for constitutional and administrative law, the new system “is unconstitutional.”

For this reason, the state union will present an appeal of unconstitutionality.

The government scissors have no limit

For COFE, “the scissors of the coalition government have no limits and advance on rights and social policies, harming workers at times when the economic situation of the family is more complex, since when a disease is , additional expenses are generated that affect the family economy”.

The union understands that the changes that were made in Parliament to the original project of the Executive Power establish that, during the illness, there will be nine days in the year (alternate or consecutive) that do not generate a discount, while from the tenth day You will receive 75% of salary. Which, for COFE, means “a salary reduction of 25%”.

“For the coalition government, calculator in hand, this means a possible saving of 90 million dollars. Behind the discourse of discrediting the state worker, the central objective of shrinking, cutting back and violating the rights of public workers is concealed, ”said the Confederation.

Likewise, they reject the fact that the measure is applied to the central administration and decentralized services, which have suffered, in the last two and a half years, “the government’s most regressive adjustment policy.”

“These adjustments will cause investment cuts, termination of contracts, cuts of more than 3,000 jobs, closure of offices throughout the country, mainly in the interior, dismantling of services, suppression of social policies at the most critical moments of the pandemic. , and reduction of operating expenses, among others”, indicates the union.

For the confederation, the central objective of the government “is clear: to deepen the system of inequality, increasing the wealth of those who have the most, harming and extracting directly from the pockets of workers, retirees and pensioners that brutal increase in the concentration of wealth”.

They affirm that the new medical licensing system “is one more provision of the government that advances in this direction.”

From COFE they have made concrete proposals that “none were considered by the government or the legislators.”

“We believe that the focus should be elsewhere and not on the general cut and damage,” they say.

The union agrees with the government that situations of abuse must be combated, but not through a system that harms all public workers.

“The BPS has recognized the difficulties in managing the new medical licensing system in the public sector. Added to this is the fact that, at the time of medical certification, the treating doctor is not identified in each health provider, which creates more difficulties in managing the new system”, considers the union.

They argue that the new Accountability Law, which was voted by the legislators of the coalition, did not transit any area of ​​collective bargaining, “in breach of Law 18,508, of collective bargaining in the public sector.”

Proposals

Among the proposals presented by COFE, are: to install prevention and health services in public agencies; a serious and deep analysis of the determination of the causes of the diseases and the link to the performed task, adopting the necessary preventive measures; Provide adequate personnel and resources to the ASSE certification department so that the necessary controls can be carried out in the event of an illness; that the organizations convene the medical boards within the stipulated periods; that the dismissal of the official be established in the event that reality is distorted; implement the compulsory data crossing of all public bodies with the BPS and an adequate audit and control system; and to implement a gradual system where in a first stage the focus is the improvement of controls and follow-up and then, if necessary, analyze other ways of addressing the situation”.

COFE regrets that its proposals have been ignored by the government, whose position focused solely on the final number of budget cuts.
