The Third National Collegiate Criminal Court granted the appeal presented by the Prosecutor’s Office and the Money Laundering Prosecutor’s Office to avoid the annulment of the oral trial against Keiko Fujimori and more than 30 processes.
According to the resolution, the file will be sent to the National Criminal Appeals Chamber, which must evaluate the Prosecutor’s Office’s request to revoke the annulment decision and order the continuity of the oral trial. In addition, the request of the Public Ministry and the Attorney General’s Office is detailed:
“The contested order is revoked and reformed, the request requested by the technical defenses of the processors is declared unfounded; and the continuation of the oral trial is ordered,” reads in the document.
The process, which investigates the alleged irregular financing of the Fuerza Popular leader’s campaigns, had been annulled a week ago by the Third Collegiate Criminal Court, in compliance with a recent ruling by the Constitutional Court (TC).
The annulment, which takes the case back to the intermediate stage for a new prosecution control, benefits Keiko Fujimori and others involved, such as Jaime Yoshiyama, Ana Hertz and Pier Figari.
With this appeal accepted, the Criminal Appeals Chamber must schedule a hearing to decide whether the oral trial continues or whether the annulment is confirmed. The resolution does not imply a declaration of innocence for the defendants, and the case continues to be one of the most relevant in the political and judicial sphere of the country.
