The agency detailed that in 2018, the victim filed a complaint in which he recounted how, in March 2009, while he was at home with his wife, elements of the Army subdued him with blows and they took him out of his house while they asked him about the whereabouts of a person that the victim did not know.
The complaint also relates that the soldier was transferred to the facilities of the Unframed Infantry Company where he was subjected to various acts of torture by the arresting elements, who kept him detained for 33 days until, finally, he was put under arrest. disposition of the Delegation of the then PGR in Chihuahua as a defendant, since he was attributed the possession of 10 kilograms of marijuana and weapons for the exclusive use of the Army.
The victim spent a year in a penitentiary center for the crimes he was accused of, until the procedure was resolved in his favor with an acquittal.
The CNDH reported that during the investigation of this case, various contradictions were found in the statements made by three members of the army who allegedly apprehended the victim.
In addition to the fact that although the person in charge of the Infantry Company denied the participation of his personnel in the victim’s disappearance, inconsistencies were detected in his statements that confirmed his responsibility for the events, the agency reported.
In addition to this, in a confrontation between the victim and the arresting elements, one of the military elements indicated that he was forced to sign the victim’s availability, even though he did not know the facts that were attributed to the victim, under the threat of being prosecuted for the military crime of disobedience, if he did not.
