CNDH denounces arbitrary retention of foreigners by the INM

After proving that INM elements acted illegally and arbitrarily, by detaining two Ecuadorian citizens for more than 18 days despite the fact that foreigners had regular procedures for their stay in our country, the CNDH issued a recommendation for said institute to repair the harm to the victims.

Recommendation 123/2022 issued by the CNDH to the commissioner of the National Institute of Migration (INM), Francisco Garduño Yáñez, detailed that it was on September 10, 2021, when the people were detained while they were going by bus to the city of Monterrey, Nuevo León, despite having a Multiple Migration Form (FMM) granted by the Institute itself.

The victims, who were transferred to the Immigration Station of Mexico City (EM-CDMX) without any justification, remained detained and held incommunicado until September 28 of that year, 18 days after their apprehension, for which filed an application for amparo, which was resolved by the District Court, an authority that determined the cessation of the incommunicado detention of the victims and their release.

However, added the CNDH, the responsible authority did not comply with these measures, prompting the person who issued the complaint to file a criminal complaint with the Attorney General’s Office (FGR) for abuse of authority.

Due to the foregoing, and after filing a complaint, the CNDH confirmed that violations of human rights to legal security, personal freedom and freedom of movement were committed to the detriment of the two Ecuadorians, who had a regular immigration status in the country. , since they entered Mexico on August 30, 2021, through the Mexico City International Airport (AICM), where the immigration authority authorized them as visitors in the modality without permission to carry out paid activities, granting them an FMM with period of 180 days.

Given these facts, this National Commission requested the INM commissioner to collaborate in the process for the immediate full reparation of the damage caused to them.
