CMD presents project seeking to decriminalize medical acts where there is no intention to cause harm

The representative of San Cristóbal, Dr. Montserrat Santana, together with a commission from the Dominican Medical College (CMD)headed by its president, Dr. Waldo Ariel Suero, presented today, through the Secretariat of the Chamber of Deputies, a bill that seeks to decriminalize medical acts in which there is no intention of causing harm.

The president of the CMD, Ariel Suero and the representative Montserrat Santana, explained that this project does not intend to generate impunity for doctors, but rather to do justice based on the intentionality.

It is about determining whether or not there was an intention to cause harm to the patients or if the doctor, for example, acted under the influence of alcohol or narcotics.

The project proposes that if it is proven that the doctor did not intend to cause harm in the care of his patients (whether in surgeries, consultations, etc.) and that he did not act under the influence of alcohol or narcotics, he will not be penalized. . If the affected person or their family members wish to continue with the claim, the case should be heard in a civil court, not a criminal one.

As an example, the president of the CMD mentioned the case of a driver who, being completely lucid and without having ingested alcohol, suffers an accident due to a tire explosion, which causes damage to a third party. In this case, there was no intention of causing harm, so the matter would be brought to a civil court and not a criminal one. Likewise, doctors do not act with the intention of harming their patients; The incidents that occur are, for the most part, accidents.

Finally, both Dr. Waldo Ariel Suero and Dr. Montserrat Santana urged congressmen to support this bill, which would resolve an important problem and correct many injustices committed against the good intentions of medical professionals.

In addition to Ariel Suero, the commission was made up of Dr. Justo Nicasio, Dr. Ana Rita Fabián, Dr. Alejandro Soto, Dr. Máximo Martínez and Dr. Luis Alba.
