The decision supported by 63 votes in favor occurs in the midst of the diplomatic asylum that he obtained Betssy Chavez in the Mexican Embassywhile facing an oral trial for the attempted coup d’état in December 2022 during the government of Pedro Castillo.
The motion is based on the statements that the Mexican president had in defense of Castillo Terrones, who tried to dissolve Parliament in 2022. Likewise, the document presented indicates that Sheinbaum “has ignored the constitutional process that, beginning in Congresslegally and legitimately determined the vacancy of Castle“However, the former head of state has denounced that he was not removed from office with 104 votes, as established by law.
Furthermore, the motion indicates that Sheinbaum’s statements “represent not only a clear interference in the internal affairs of Peru, but also a repetitive lack of respect towards Peruvian institutions.”

On the other hand, 34 congressmen opposed the decision to declare the Mexican president persona non grata, while two abstained.
On November 4, after the diplomatic asylum granted to Chávez Chino, Sheinbaum questioned whether Peru had broken diplomatic relations with his country and considered this determination to be “out of proportion”. Likewise, the boss described Castillo’s arrest as “unfair” despite the fact that he tried to dissolve the Congress after giving a message to the Nation.
“What was done then and what we defend now is that the detention of Pedro Castillo and that, in truth, corresponded to a political issue that had been developing for a long time and also to a vision of a lot of discrimination, from a large part of what was the political class of Peru. Congress declared former President AMLO persona non grata
It is not the first time that the Congress declares a president persona non grata. In May 2023, with 65 votes in favor, the former Mexican president was qualified that way Andrés Manuel López Obrador (AMLO).
This occurred because López Obrado had comments against the management of the former head of state, Dina Boluarteand did not recognize her as the constitutional leader of Peru, after the fall of Castillo.
Despite this, AMLO responded to Parliament ironically. “Thank you very much because they declared me persona non grata; it is a sign of pride,” he said. “I would feel bad if those legislators and the lady who has power gave me a decoration or applauded me, maybe it would make me embarrassed. I would feel very bad,” he added.

In communication with The Republicthe constitutional lawyer, Diego Pomaredaassured that said decision of the Congress It has no legal relevance, but is a “declarative act” that does not escape the political sphere.
“The impact, the legal relevance of this act is completely declarative, not constitutive; that is, it does not have any relevant legal effect. Government and State policy is managed by the President of the Republic according to his functions. Congress does not have any competence to pronounce, say or have any impact on the democratic path or the country’s foreign relations,” he expressed.
“It is a purely political, declarative act that has a relevance in this area, but not a legal one, that has a direct impact on State policy,” he added.
