He Congress of the Republic approved – in the second vote – the incorporation of the crime of systematic crime In the Criminal Code. The initiative was supported by 83 congressmen, while 27 voted against.
The opinion is based on bills 5525, 5838, 5969, 5972, 6014, 6051, 6206, 6842, 6912, 6972, 7179, 7761, 7774, 8029, 8043, 8051 and 8061. This adds article 318-B to the legislative decree 635.
The document indicates that, who, through the use of ammunition, military or civil, explosive or others of similar nature, commit crimes such as kidnapping, extortion, sicariate, qualified homicide or aggravated robbery, generating terror in the population, will be sentenced with life imprisonment.
During the debate, various legislators questioned the effectiveness of the norm. Congresswoman Gladys Echaíz said that the investigation that the police have.
“The problem is not the lack of a rule, but the term that the police have to investigate. With 48 hours it is almost impossible to raise the secret of communications, review cameras or individualize the authors. What is needed is to expand to 15 days the detention in severe cases, as already happens in crimes of terrorism,” he said.
For his part, congressman Diego Bazán considered that the norm “does contribute, because he typifies a crime that does not exist today.”
“On January 20, 2025 they dynamited the headquarters of the Public Ministry, and on August 15 they did the same in a busy street in Trujillo. We need to be blunt against criminals,” he said.
The rule must be sent to the Executive Power for the President of the Republic, Dina Boluarte, promulgates or observe it.
