December 25, the national Christmas holiday, is a day when workers have the right to rest and receive regular remuneration. However, if you work on this date, your pay slip will reflect an increase, as reported by the National Superintendence of Labor Supervision (Sunafil).
How much should you receive?
If you work on December 25 without compensatory rest, your remuneration will be as follows:
- Regular daily remuneration: Included in your monthly salary.
- Additional payment for work performed: It corresponds to the equivalent of your daily remuneration.
- 100% surcharge: An extra amount equal to the daily salary for working on a holiday.
For example, if your monthly salary is S/1025, your daily remuneration is S/34.17. In this case, your payment slip will be:
- Regular remuneration: S/34.17.
- 100% surcharge: S/34.17.
- Total: S/68.34 additional to your monthly salary, leaving it at S/1093.34.
Fines for defaulting employers
Employers who do not respect these labor rights could face financial penalties, the magnitude of which will depend on the type and size of the company.
What happens if you work in the early hours of December 24 to 25?
Sunafil clarified that if your day begins on December 24 and ends on December 25, the 100% surcharge does not apply. This is because this benefit is only granted when the work is carried out completely during the holiday.
