The Ministry of Development and Social Assistance, Family and Fight against Hunger and the National Social Security Institute (INSS) published this week joint ordinance which updates the Continuous Payment Benefit (BPC) rules.
Among the new features is the possibility of maintaining the benefit even in the event of changes in per capita family income. – BPC will continue to be paid whenever the income of the last month analyzed or the average of the last 12 months remains equal to or less than a quarter of the minimum wage.
Another important point is the automatic conversion of BPC into inclusion aid. Whenever the INSS identifies that a person with a disability has entered the job market, with remuneration of up to two minimum wages, the benefit will be converted immediately, without the need for a new application.
In an interview with radio stations during the program Good morning, Ministerproduced by Brazilian Communication Company (EBC), the Minister of Development and Social Assistance, Wellington Dias, commented on the changes.
“We are working to encourage employment for BPC people. To guarantee this condition”, he explained. “When they lost their jobs, they went back to a forensic examination queue. Not now. They’re at BPC, they got the job, they earn up to two salaries [mínimos]she receives half of the BPC plus salary.”
“When she loses her job, she automatically goes back to BPC,” he said. “Forensics is our problem. We even cross-reference its data with the CNIS [Cadastro Nacional de Informações Sociais]. This gives an excellent result”, concluded the minister.

The BPC, provided for in the Organic Social Assistance Law (LOAS), guarantees a minimum wage per month for elderly people aged 65 or over or for people with disabilities of any age.
In the case of a person with a disability, the condition must cause long-term physical, mental, intellectual or sensory impairments (with effects for at least two years), which make it impossible for them to participate fully and effectively in society, on equal terms with others.
The ministry reinforces that the BPC is not a retirement and that, to be entitled to it, it is not necessary to have contributed to the National Social Security Institute (INSS). Unlike social security benefits, the BPC does not pay thirteenth salary and does not leave a death pension.
