The Ethics Council of the Chamber of Deputies filed a lawsuit against Deputy Eduardo Bolsonaro (PL-SP) on Tuesday (23) for breach of parliamentary decorum. The representation, made by the PT, calls for the loss of mandate. According to the party, Eduardo Bolsonaro has used his stay in the United States to reiterate “reiterately to defame institutions of the Brazilian state.”
The decision was communicated by the Chairman of the Council, Deputy Fabio Schiochet (Brazil-SC Union). Now, the regimental period of 90 days is opened for the board to complete the evaluation of the request.
Deputies Duda Salabert (PDT-MG), Paulo Lemos (PSOL-AP) and Delegate Marcelo Freitas (União Brasil-MG) were nominated by draw to report the case. The decision, however, about who will be with the rapporteur should be taken in the coming days by the committee chairman.
In the representation, the PT claims that Eduardo Bolsonaro has attacked with “special virulence” the Federal Supreme Court and his ministers, whom he has publicly called “Milicians togados” and “dictators”. The text cites the recent interview of the deputy to CNN Brazil, in which he textually stated that “no amnesty for Jair Bolsonaro, there will be no elections in 2026”.
In the PT’s evaluation, the conduct is a serious threat to the constitutional order and the realization of the electoral process, “hard core of popular sovereignty”.
“Parliamentary immunity is not a safe conduct for the practice of attentive acts to the institutional order, nor a protective cloak for incitement speeches to democratic rupture,” says the PT in representation.
The document also cites the fact that the 120 -day license, requested by the deputy in March, has already expired on July 20, “without the represented that returned to the country or required any extension, which is evident non -compliance with regimental rules”, “deliberate, continuous and intentional”.
“It is the duty of the parliamentarian to ensure the honor of the mandate that exercises and strictly comply with the functional limits that regulate it. His permanence abroad, associated with public action against national institutions, while stolen with minimum regimental obligations of presence and deliberation, represents serious attack on the decorum and integrity of popular representation,” says the representation.
Three other representations against Eduardo Bolsonaro, two from the PT and one from PSOL.
Fabio Schiochet said he requested at the board of directors to appeal to the three requests to process together. The request was made on September 9 and there is no regimental deadline for the table response.
“I asked to appeal because, of the four representations, three are related, that is, similar. We can not have a rapporteur asking for filing, another, perhaps, the cassation, and a third, the suspension. There is no regulatory deadline for the table to return the attachment to the Ethics Council. But I believe that in the coming days or until next week the President [da Câmara] Hugo [Motta] It must return the granted or rejected process, ”he said.
Leadership
On the morning of Tuesday, the president of the House of Representatives, Hugo Motta (Republicans-PB), denied the appointment request by Eduardo Bolsonaro to the position of leader of the minority in the house.
The nomination was made by the leader of the PL, Deputy Sostenes Cavalcante (PL-RJ), with the argument that an act of the Board of Directors, edited in the administration of Eduardo Cunha (MDB-RJ), released party leaders to register in plenary. Eduardo Bolsonaro licensed in March and traveled to the United States, where he settled residence.
“The decision It was strictly technical. We heard the opinion of the General Secretariat of the Board of Directors who decided to have no possibility of the exercise of parliamentary mandate being absent from the national territory, there is no precedent in the house, ”Motta explained during an interview before the leadership meeting on Tuesday afternoon.
The license ended on July 21, but the parliamentarian has not returned to Brazil and has accumulated non -justified absences in plenary sessions. The Constitution provides for the cancellation of deputies who lack one third of the ordinary sessions, except license or authorized mission.
According to the opinion of the Board of Directors, there is only the possibility of remote registration for parliamentarians on an official mission authorized by the House, which is not the case of Eduardo Bolsonaro. The deputy also did not even communicate to the presidency of the House the absence of Brazil. According to the Bureau, the situation configures “by itself a violation of the parliamentary’s functional duty”.
“The deputy is not in the national territory, as we all know, and the Chamber was not communicated from its absence of the national territory,” emphasized Motta.
