The House of Representatives installed on Tuesday (9) the special commission that will analyze the proposal of amendment to the Constitution (PEC) 18/25, the so-called PEC of Security. At the meeting, Deputy Aluisio Mendes (Republicans-MA) was elected, for 25 votes, president of the board. The vice president will be Deputy Alberto Fraga (PL-DF), also elected with 25 votes. THE Deputy Mendonça Filho (Union-PE) was designated rapporteur. The Commission, made up of 34 holders and the same number of alternates, will have up to 40 plenary sessions to complete the work.
Among other points, the proposalprepared by the Federal Government, Constitutionalizes the Unified Public Security System (SUSP), expands skills from security agencies, such as the Federal Police (PF) and the Federal Highway Police (PRF); and strengthens the role of the Union in the planning and coordination of public safety.
In the case of PF, PEC expresses its competence to investigate and suppress infractions committed by criminal organizations and private militias, whose practice has interstate or international repercussions and requires uniform repression. It also explains its performance in the investigation of criminal offenses that affect the union’s assets or are within their interest, such as the environment.
“We are all aware that public safety in this country today is one of the problems that most afflict our population. It is very important that we are aware of this and that we can, in the discussion of this PEC, to deliver to Brazilian society what it wants most, which is more social peace and tranquility to our families,” said the committee chairman.
The Union will compete to coordinate the Unified Public Security and Social Defense System and the Penitentiary System, through strategies that ensure the integration, cooperation and interoperability of the organs that compose it.

The text also explicit that states and municipalities will remain responsible for the command and management of their security forces.
“Indeed, the attributions of the federated entities in public security will be maintained in the new institutional arrangement proposed, that is, the common and competing competences and the subordination of the military, civil and criminal police and the military fire brigade to the governors of the states and the Federal District,” says the text of the Ministry of Justice and Public Security with the justification of the PEC.
Another point is that PEC alters the Constitution with the purpose of attributing private competence to the Union to legislate about general rules on public security, social defense and penitentiary system, thus ensuring uniform and integrated action of all federation entities in these areas. This without prejudice to the Union, the States and the Federal District have competing competence to legislate on the subject.
PEC rapporteur, Mendonça Filho, said he believed that the public security policy is made with cooperation with states and municipalities, with the Union a central role.
“Even with regard to coping with criminal factions, international drug trafficking, international arms trafficking, control of our borders, but if there is no cooperation and direct performance of states and municipalities, it is impossible for you to fight crime. And unfortunately, in Brazil, is gaining power, gaining power, entering segments that they once did not act: fuel, dominating internet service, dominant service, Territories, and we have to enforce the rule of law throughout the country, ”he said.
The rapporteur also said that he should present until next week a work script for the board, with hearings with researchers, authorities, and members of security forces, among others. The president of the Chamber of Deputies, Hugo Motta (Republicans-PB), said that the proposal will enable a greater involvement of the Union in public safety, “more demanded theme by Brazilian society”.
“A project of amendment to the Constitution coming from the Federal Government, through the Ministry of Justice and Public Security, which comes to this House so that we can improve this text, so that the House of Representatives can make its contribution, regarding constitutionalizing a text that guarantees the citizen a safer country, where families can have the free right to come and go,” he said.
