Federal deputies approved this Wednesday (15)by 268 votes to 167, request to suspend criminal proceedings against congressman Gustavo Gayer (PL-GO) pending in the Federal Supreme Court (STF). There were 4 abstentions.
The request was presented by the deputy’s party. THE The Court will be notified of the decision.
THE Federal Constitution provides that the House of the parliamentarian against whom a complaint for a common crime has been received is informed of the fact to decide, within 45 days, whether to agree with the continuation of the action or whether to suspend it the action while the parliamentarian is in office.
The Plenary followed the opinion of the rapporteur, deputy Zé Haroldo Cathedral (PSD-RR), who defended the suspension of the process and was approved by the Constitution and Justice Committee of the Chamber of Deputies (CCJ).
Gayer is accused of insult, slander and defamation in a lawsuit filed by senator Vanderlan Cardoso (GO)who is licensed from the mandate. In a video published on his social network in February 2023, Gayer criticized, with insults, the senator, the former president of the Senate Rodrigo Pacheco (PSD-MG) and the current one, Davi Alcolumbre (União Brasil-AP), and the Federal Supreme Court.
The rapporteur argued that the Constitution guarantees freedom of expression to parliamentarians and that crimes of insult, slander and defamation have not been proven.
The action against Gayer was received by the 1st Panel of the STF, under the report of Minister Alexandre de Moraes. The process is in the final arguments phase.
