The Provisional Measure (MP 1085/21), which creates the Electronic System of Public Records (Serp), was approved by the plenary of the Chamber of Deputies this Thursday (5). According to the text, which is now being analyzed by the Senate, the registries must carry out their acts electronically and must be interconnected. The change will allow, for example, a notary to make an electronic query about something registered in another city.
The text approved by the deputies foresees that the interconnection will be effective until January 31, 2023. The resources for the adoption of the new system will come from a fund subsidized by the notaries. Serp’s national operation will be the responsibility of a non-profit, private legal entity, under the terms to be established by the National Justice Department of the National Justice Council (CNJ).
âSerp modernizes the Brazilian registry system, providing remote service for users of all services through internet accessâ, said the rapporteur of the matter, deputy Isnaldo BulhĂ”es Jr (MDB-AL). He presented a favorable opinion to the original MP and rejected the 316 amendments presented to the text.

The provisional measure was criticized by opposition parties. The deputy leader of the minority in the House, deputy Henrique Fontana (PT-RS), criticized the fact that the system is operated by a private structure. âDoes anyone here think it reasonable to hand over the entire restricted area of ââthe country to a private structure? â, he questioned. The same criticism was made by deputy Glauber Braga (Psol-RJ). âThe national data structure has to be public,â he said. A PT highlight intended to exclude this possibility, but it was overturned during the vote.
