The Chamber of Deputies approved this Tuesday a bill that defines the procedures for the National Electric Energy Agency (Aneel) to return to the consumer the values of the Social Integration Program (PIS) and the Contribution to the Financing of Social Security ( Cofins) overpaid by distributors through revision of energy tariffs. The text goes on to sanction. 
According to the proposal, Aneel should promote an extraordinary tariff review this year, when the amounts to be returned come from court decisions prior to the coming into force of the future law. This situation just doesn’t slow down two electricity distributors. The review will also apply to distributors with approved tariff processes as of January 2022.
According to data from Aneel, of the R$ 60.3 billion in credits to be returned by the Union to distributors, R$ 47.6 billion have not yet been returned to consumers. The rest have entered tariff revisions since 2020 that have resulted in an average reduction of 5% so far.
The agency explained that, due to the different data on the filing of actions by the distributors, the results will be different depending on the region and area of operation of the concessionaires. As the reviews consider other costs that could increase the rate in the review, the values will not necessarily imply a reduction in the invoice, but a smaller increase.
