The plenary of the Chamber approved this Wednesday (8) a bill that prevents the levy of the Tax on the Circulation of Goods and Products (ICMS) on the additional electricity of tariff flags. The text goes to the Senate for analysis.
The tariff flags were created by the National Electric Energy Agency (Aneel) to more clearly identify situations of water scarcity and can be green (no additional charge), yellow (intermediate increase) and red (1 and 2 and have a maximum increase ). Due to the drought in several regions of the country last year, between September 2021 and April 16, 2022, the “water scarcity” tariff flag was in effect, created by the Electric Sector Monitoring Committee (CMSE), which is linked to the Ministry of Health. Mines and Energy.
All taxes that are already levied on electricity are levied on the amounts represented by the tariff flags: PIS and Cofins (federal), ICMS (state) and Contribution to Public Lighting (CIP), of municipal competence. By the calculations of one of the authors of the text, Hildo Rocha (MDB-MA), with the approval of the project, the consumer can save up to R$ 4 for each 100 kW consumed, in the case of a tariff of 27% of ICMS, charged by some states.
