The Plenary of the Chamber of Deputies approved late Tuesday night (24) the anti-faction bill, which provides for increased penalties for participation in a criminal organization or militia. The proposal was sent by the federal government to Congress on October 31but there were changes in both the Chamber and the Senate.

In the Chamber, the rapporteur was deputy Guilherme Derrite (PP-SP), who presented a substitute for Bill 5582/25, authored by the federal government.
The final text will now go to President Lula for approval. The project stipulates the classification of common conduct by criminal organizations or private militias.
The expected penalty is imprisonment of 20 to 40 years for a crime categorized as structured social domain. Favoring this domain will be punished by imprisonment for 12 to 20 years.
Changes
In the Chamber, the Anti-Faction bill was called “Legal framework to combat organized crime”. Most of the changes made by the Senate ended up being rejected.
The taxation of bets to create a fund to combat organized crime and changes in the Federal Police’s role in international cooperation were also excluded.
This Wednesday, the president of the Chamber Hugo Motta announced that the possible The future law should be named after former minister Raul Jungmann, who died last month.
Restrictions
According to the final text, there will be restrictions on those convicted of these crimes, such as a ban on benefiting from amnesty, grace or pardon, bail or parole.
Furthermore, dependents of anyone involved in organized crime will not receive prison assistance if they are provisionally imprisoned or serving a custodial sentence, in a closed or semi-open regime, due to having committed any crime provided for in the project.
People convicted of these crimes or kept in custody until trial must be held in a maximum security federal prison if there is concrete evidence that they exercise leadership, leadership or are part of the command nucleus of a criminal, paramilitary or private militia organization.
Agreement
Chamber President Hugo Motta said that the project represents the toughest response ever given to organized crime. At the beginning of the discussion, he explained that the federal government and the opposition had reached an agreement to speed up the vote.
For the leader of the PSB, deputy Jonas Donizette (SP), the text was improved with positive points from the Chamber and the Senate. Deputy Captain Alberto Neto (PL-AM), deputy leader of the PL, highlighted that the project will be “the starting point” to remove criminal organizations from politics.
Deputies from the government base, on the other hand, criticized the prominent approval to withdraw the creation of the Contribution for Intervention in the Economic Domain (Cide) on bets to finance the fight against organized crime. Representative Lindbergh Farias (PT-RJ) said that the charge would bring R$30 billion to public security.
