The magistrate of Constitutional CourtCésar Ochoa, denied that his institution is “aligned” with the Congress of the Republic and rejected the questions of a political sector that points out that the highest interpreter of the Constitution defends the interests of the Legislature.
“It cannot be said that the Constitutional Court pleases Congress,” he said in RPP.
Likewise, he detailed that, in October 2024, the TC rejected the jurisdictional claim presented by the Legislature against the rulings of the Judiciary in favor of the National Board of Justice.
“Who did we agree with? “Are we an appendix of Congress?” he questioned.
The magistrate also recalled that in 2022 his institution annulled an “imputation” for treason against the then president Pedro Castillo.
“So, what is the factual basis to maintain that it is a Constitutional Court aligned with Congress?” he said.
Ochoa Carich questioned the politicization of justice through lawfare. “Lawfare must be avoided; that is, use constitutional or judicial processes to disqualify the political adversary.”
