Cenidh denounces the "legal aberrations" committed during political trials in "El Chipote"

The Nicaraguan Center for Human Rights (Cenidh) carried out an analysis of the different human rights abuses and violations committed by the Daniel Ortega regime during the trials against the current political prisoners detained between May and November 2021, which were taken to carried out in the Judicial Assistance Directorate (DAJ) in Managua, a torture center where this group of opponents remains that brings together the leaders of social groups.

The organization indicated that the lawyers of the hostages of conscience denounced a series of violations of their work, among which they highlight requisitions and interruption of the defense.

They also point out that during the hearings, some judges had their defense arguments interrupted and were denied their right to question the witnesses proposed by the Prosecutor’s Office, “who were mostly the same members of the National Police.”

Violations of the Constitution and human rights

Regarding the constitutional and human rights violations during the judicial processes against the political prisoners of the Ortega dictatorship, the Cenidh reported that were 16 human rights violated at 47 processed to date.

The physical, mental and moral integrity, individual freedom, respect for honor and reputation, respect for the inviolability of his home and communications of the lawyers and the political prisoners themselves were also violated.

Other “legal aberrations” include the right to equality before the law, the principle of legality; arbitrary imprisonment. Above all, the right to due process was violated.

“The partiality of the judicial authorities in the processing of the trials was evident: all the requests of the Prosecutor’s Office were declared admissible and even the exact sentence requested by the Prosecutor’s Office was imposed, even when it was not substantiated, evidently violating the principle of equality before the law,” the organization said.

The Cenidh reported that of the current political prisoners, two (Álvaro Vargas and Michael Healy) have not yet been tried; The former OAS ambassador, Edgard Parrales, is currently undergoing a hearing and in the case of Hugo Torres, he died in the custody of Daniel Ortega’s Police.

All the current political prisoners were captured between May and November 2021, prior to the disputed presidential elections held on November 7, where Ortega prevailed to govern for another five years.
