Cenares favored the brother of Aníbal Torres knowing that the company was disqualified

However, the OSCE clarified that on the same April 20 that it issued the sanction against Aldem, it also notified Cenares, which reports to the Ministry of Health, “through the electronic system” of its court.

“The impediment was set up because Mr. Víctor Antonio Torres Vásquez was a representative of said company and Contract No. 861-2021-CENARES/MINSA was signed, ‘Rental service of premises for use as a store of thermal boxes’, for the amount ascending to S/35,000″, specified the OSCE.

The State Contracting Law (Law No. 30225) stipulates in its literal d) of article 11 that they are prevented from contracting with public entities “the spouse, partner or relatives up to the second degree of consanguinity or affinity” of ministers and deputy ministers .

This year alone, during the Castillo government, Aldem SAC has billed 2,359,200 soles under three service orders. But two of these last orders were issued to him when he already had a sanction.

The OSCE also specified that, to date, Aldem has the disqualification in force until September 24 of this year.

Last week, Prime Minister Aníbal Torres lashed out at those who question whether his brother gets these benefits despite what the law says.

“My brother is an entrepreneur. Of course, as an entrepreneur he has income from private activity, but also from his store; and if he wins millions, that’s the Peruvian, he kills us with envy. Let those who are against it die of envy, ”he declared.

Meanwhile, the representative of the Aldem company, Bruno Montoya, expressed on Radio Exitosa that they did not break the law because, according to his interpretation, the infraction proceeds only if the contract is signed with the same sector in which Víctor’s brother is located. Towers.

The contract that led to the sanction was signed on October 27, 2021, when Aníbal Torres was Minister of Justice. According to Montoya, the punishment does not apply because his company closed a commercial agreement with the Ministry of Health.

Made aware of the information provided by the OSCE to this newspaper, the director of Cenares indicated through a letter that he was not informed by his own people of Aldem’s disqualification when they signed the April 25 addendum.

“It has been ordered that the areas involved report: i) the reasons why they were not reported to my office, ii) if applicable, the necessary corrective actions will be ordered,” he said.

Regarding the application of the addendum, José Gonzáles insisted that the rule was not violated because it only prevents the company from registering new contracts for the duration of the sanction. In this line, he referred that the addendum is not a new contract, but “an additional benefit”.

Gonzáles said that it was not irregular to agree on the addendum with the company despite the sanction because, for that month of April, the OSCE resolution was issued in the first instance.

“As much as there is a sanction resolution in the first instance, it did not take effect until it was declared firm, that is, from May 24 to September 24, 2022,” he alleged. In other words, Torres continues to bill with the State and it is possible that he will continue to do so.
