The Constitution and Justice Committee (CCJ) of the Chamber of Deputies rejected by 32 votes to 27 the report by deputy Diego Garcia (Republicanos-PR), who took a stand against the impeachment of deputy Carla Zambelli (PL-SP).
Representative Claudio Cajado (PP-BA) was appointed as the new rapporteur and should recommend the impeachment of the parliamentarian, already sentenced by the Federal Supreme Court (STF) to 10 years in prison, a fine and the loss of her mandate for invading the systems of the National Council of Justice (CNJ).
During the CCJ debate, Carla Zambelli, who is imprisoned in Italy, made her defense via video call. Before her arrest was ordered, the deputy fled to Italy, where she was arrested and awaits a decision from the Italian court on the extradition request made by Brazil.
On Tuesday (2), the rapporteur of the deputy’s impeachment process at the CCJ, deputy Diego Garcia (Republicanos-PR), issued an opinion against the loss of the parliamentarian’s mandate, based on a report presented by an expert hired by the defense. In the same session, the voting process on the report was interrupted after collective view request.
The leader of the PT in the Chamber, Lindbergh Farias (RJ), even declared that he would file a writ of mandamus with the STF so that the Board of Directors could comply with the Court’s determination.
On Tuesday afternoon (9), before the approval of the bill that provides for the reduction of sentences for people convicted of the undemocratic acts of January 8, 2023 and the attempted coup d’état, the president of the Chamber of Deputies, Hugo Motta (Republicanos-PB), announced that it would take the cases against Carla Zambelli to the plenary and Delegate Ramagem (PL-RJ), already convicted by the Federal Supreme Court (STF), and that of deputy Glauber Braga (PSOL-RJ), as of this Wednesday (10).
For the plenary of the Chamber of Deputies to revoke the deputy’s mandate, an absolute majority of votes in favor is necessary, which corresponds to at least 257 votes from the 513 parliamentarians in the House.
