He stressed that arrangements or payments of hours can be made between employers and employees, in order to cover the rest of the days and thus have more free time in their favor.
For yet another year, the carnival festivities throughout the country have been suspended due to the Covid-19 pandemic and an increase in cases, as was recently established in Executive Decree No. 6 of the Ministry of Health (Minsa), which ordered it.
The advisor to the Superior Office of the Ministry of Labor and Workforce Development (Mitradel), Carlos Ayala, cleared up doubts about days off and how they should be managed in companies, reiterating that there should be no variations according to what is already established in the Labor Code that indicates that it is part of the mandatory days off or rest, which means that on Carnival Tuesday there is no work.
According to the advisor, if you work that day, you must pay or remunerate with the corresponding surcharges.
He stressed that arrangements or payments of hours can be made between employers and employees, in order to cover the rest of the days and thus have more free time in their favor.
In the event that it has been established that Carnival Monday is free, it will be up to the employer and the treaty with its unions, to decide whether or not this clause applies.
