protection raised by Claudia Marcela Castro Dorado who applied for the position and has already been admitted.“It is available as a precautionary measure to paralyze the selection and appointment process of the State Attorney General until the hearing for consideration of this constitutional protection action is held”says the resolution signed by Caranavi judge, Sandy Madeleine Rodríguez.
The Second Constitutional Chamber of La Paz admitted an action for Constitutional Amparo against the selection process of the Attorney General of the State, which is in the preliminary phase before the final designation by the plenary session of the Plurinational Legislative Assembly.
This appeal was filed on October 8 by Porfirio Machado Gisbert, one of the jurists who ran unsuccessfully to be a prosecutor and previously to be nominated as a candidate for the Judicial Council.
The plaintiff indicated in his memorial that his rights and guarantees had been violated by the members of the Mixed Commission of Plural Justice, Public Ministry and Legal Defense of the State of the Plurinational Legislative Assembly, during the preselection process for prosecutor.
The Constitutional Chamber determined that the public virtual hearing will take place at 2:00 p.m. on October 25. In that legal hearing, a ruling could stop the prosecutor selection process that must end before October 23, the day Juan Lanchipa’s administration ends.
