Unfortunately, some people do not pass the naturalization test for various reasons, of which we can cite: 1) Not passing the written test; 2) failing the US history test; or 3) fail to meet the requirement of good moral character at the time of application.
In case my Naturalization application was denied, what can I do? It all depends on the reason for the denial. If your application was initially denied because you did not pass the written or civic exam, the immigration officer gives you a second chance. Basically, a second appointment is scheduled and you are retested for the portion you failed. If you still do not pass, then you can apply again and pay the corresponding fee. You should not wait any kind of time to apply, since the only thing that is stopping you is your level of English or knowledge of the history of the United States.
However, if the reason is that you do not possess good moral character at the time of applying, depending on the date of the incident that is causing this determination of lack of character, it will be the date you can apply for naturalization. As an example, let’s imagine that a person applied for government assistance due to lack of resources and the person lied, indicating in the application that his resources were less. If the person at the time of the interview continues to receive this assistance and the officer becomes aware of this situation, the applicant must wait 5 years to apply, since the determination was made at that time and the lie has been sustained throughout that time. .
On the other hand, if a person was arrested (said arrest is reported in the application) and as a result of that arrest, the person is found not to have moral character; the applicant then calculates five years from the date of the incident and not the date of the denial. Be very careful with this, since there are arrests that permanently prohibit you from applying for naturalization. Therefore, it is important that you always consult with a lawyer before starting any migration process.
