The justice determined this Wednesday to place house arrest against Rómulo Calvo, for the alleged crimes of breach of duties and improper exercise of the profession. This measure left both the defense and the prosecution unsatisfied, who stated that they will appeal the decision.
“We believe that the judicial resolution is not adequate, not only because the judge has not complied with properly substantiating and with due consistency the crime of breach of duties, but also considering the criminal type, which is a fairly simple criminal type, the The judge has not considered the principle of proportionality and has imposed an extremely strong precautionary measure,” Calvo’s lawyer, Martín Camacho, told Central Affairs.

As detailed, house arrest is not for the whole day, but “on weekdays” from 9:00 p.m. to 6:00 a.m., but they also consider that “it is not a light measure.” In addition to the arrest, the president of the Pro Santa Cruz Civic Committee is prohibited from leaving the country, must pay bail of 30,000 bolivianos and is ordered to go to the Palace of Justice every week to sign an act.
“The appeal has already been filed. Resolutions that are issued orally are appealed orally at the same time, so Rómulo’s defense attorneys have filed the appeal at the time,” he said.
For his part, the deputy of the Movement Towards Socialism (MAS) Hernán Hinojosa, who filed the complaint against Calvo, considered that the measure is very “mild” and stated that he will present an appeal so that the leader is sent to Palmasola with preventive detention.

“We respect (the measures), but we do not agree. As a complaining party, we have made it known in full hearing that we are going to appeal this measure because we are not satisfied, they are minor measures for us because he should be in preventive detention in Palmasola, which is what had been requested,” he stressed.
“We have presented sufficient evidence that he has not gone to work, as well as the fact that in 2005 he joined the Caja (Petrolera de Salud) but signs as a specialist. (…) Today I have a meeting with my lawyers and we are going to analyze what are the steps to follow legally and under what arguments are we going to appeal these measures,” he added.
