Calculate how much you will be paid if you work on the holidays of July 28 and 29

July closes with a long and holiday pay. This Thursday the 28th and Friday the 29th in Peru the National Holidays are celebrated and it is a holiday for workers in the public and private sectors. Companies make additional payments to their employees and, if they work, the extra payment will be higher, according to the law. Do you know how much they will pay you if you work one of those days or both?

If you are one of the workers who will carry out their duties normally, whether in person or remotely, we explain how you can calculate how much you will receive according to law.

In accordance with Legislative Decree 713 and the exceptional labor regulations that govern during the period of national emergency, this holiday is duly remunerated, without the obligation of workers to provide services. Remuneration must be received in full and without any condition, even if the worker is absent or late during the week.

WILL I BE PAID TRIPLE IF I WORK ON JULY 28 AND JULY 29 HOLIDAYS?

If a worker is going to work on Thursday, July 28 and/or Friday, July 29, they will receive a triple payment for each day worked -without substitute rest- for the following concepts:

  • A daily remuneration for the holiday: it is already included in the monthly salary.
  • A second remuneration: the additional payment of a day for the work done.
  • A third remuneration: the additional payment of a day for having worked the holiday without substitute rest.

How do I calculate my payment if I work on the holiday?

Example: If your salary is S/ 1,500, the daily remuneration will be S/ 50. If you work on this holiday for National Holidays without subsequent rest, you must multiply 50 by 3, that is, you will receive S/ 150 for each day. If you work both holidays, you will be paid a total of S/300.

What if I do remote work?

It’s the same situation. Personnel who have been providing remote work -from their homes- and do not work on July 28 and/or 29, have the right to receive their remuneration without working, but if they work they must receive triple.

If you agree with your employer that you are going to work on said holiday, without substitute rest, you will be entitled to triple payment of your daily salary.

HOW IS THE PAYMENT OF HOLIDAYS DUE TO NATIONAL HOLIDAYS IF I HAVE LATER SUBSTITUTE REST?

In the event that you work on July 28 or 29, or both days, but instead of a payment you want to have a day off, you can choose to request a substitute rest for that day worked. In other words, if you work on the May holiday, you can request a break another day without any additional payment. This option is also given to employees who are working remotely or not in person at their work centers.

How do I calculate my payment if I work on the holiday, but want to rest afterwards?

Example: If your salary is S/ 1,500, the daily remuneration will be S/ 50. If you work on this holiday for National Holidays. with subsequent rest you must multiply 50 by 2, that is, you will receive S / 100 for each day. If you work both holidays, you will be paid a total of S/200. This is the ordinary payment for the holiday because later you will be able to recover the day worked.

WHAT HAPPENS IF THE HOLIDAY FALLS ON MY REST DAY?

If the mandatory weekly rest day coincides with a holiday, the worker must be paid double for the following concepts:

  • One day’s pay for the holiday, in addition to pay for the weekly rest day.

WHAT HAPPENS IF I’M ON VACATION?

Workers who are enjoying annual vacations during the July 28 and 29 holiday are not entitled to additional remuneration; Well, before the vacation break, the company paid them their remuneration, which already includes the holiday. These holidays are paid in full, and are not subject to subsequent compensation.
