A federal judge based in Almoloya de Juárez, state of Mexico, ordered the prosecution of Gildardo López Astudillo for organized crime, Cape Gilidentified as one of the main people involved in the disappearance of the 43 students from Ayotzinapa,
On September 6th Cape Gil He was placed at the disposal of a control judge, who ordered his internment in the Federal Social Readaptation Center number 1 (Cefereso 1), Altiplano, in the state of Mexico, where he will remain imprisoned.
After requesting an extension of the deadline from 72 to 144 hours to determine his legal situation, the control judge considered that the Attorney General’s Office (FGR) provided sufficient evidence to subject him to criminal proceedings.
Cape Gil He was arrested for the first time in September 2015, based on an arrest warrant obtained from the accusations of cartel members. United Warriors also involved in the disappearance of the 43 students in September 2014.
Tortured and collaborating witness
Cape Gil He was accused of organized crime and illegal deprivation of liberty against the 43 normalistas; however, after being imprisoned for almost four years, on August 24, 2019, the first district court in federal criminal proceedings in Tamaulipas ordered his release because he was allegedly subjected to acts of torture, without analyzing whether there was legally obtained evidence to prove his responsibility in the events.
In 2020, the Special Prosecutor’s Office for the Ayotzinapa case granted him the benefit of being a collaborating witness, and this year it restarted the proceedings against him.
The federal Public Prosecutor’s Office obtained two arrest warrants, which is why he was arrested earlier this month by personnel from the Navy and the FGR.
