The business associations, members of the National Council for Labor and Employment Promotion (CNTPE), maintain that the issuance of Supreme Decree No. 001-2022 – TR, which restricts the contracting of outsourcing services in the Peruvian business system, threatens the right to free enterprise and the right to have a formal job for 200,000 people.
In this sense, through a statement, the Ministry of Labor and Employment Promotion (MTPE) is exhorted to respect the institutionality and legality contemplated in the Constitution, which according to the unions, have been violated with this provision.
In addition, they allege that the resolutions of the Judiciary and Indecopi, indicating that it is an illegal measure, mark a clear tendency, in judicial and administrative jurisdiction, respectively, that the MTPE does not have the competence to impose measures of this nature. because the Outsourcing Services Law in the country is violated.
“We consider it unacceptable that, in a state of law, the MTPE has threatened to carry out legal and administrative measures against the competent entities and authorities to determine the legality of the regulations,” states his statement.
“This action threatens the country’s institutions, by not respecting the powers of institutions called to defend legality and protect workers, companies, citizens and the State itself from any abuse”they add.
Finally, the business associations, members of the CNTPE, reiterate their commitment to work for sustainability and the promotion of employment in Peru, this being the best mechanism to face poverty and generate well-being in the country.
