This December, for the Christmas concept, employees, both in the public and private sectors, will receive “extra money” as compensation for their work. Find out who receives a Christmas bonus and who receives a bonus. Next, we detail five points of each concept so that you know the difference.

5. What is Christmas bonus?
According to national law, the Christmas bonus is a bonus that is delivered only to public officials and servants appointed and hired under the regime of Legislative Decree No. 276 and Law No. 29944.
4. Who receives a Christmas bonus?
The Christmas bonus will be for officials and servers appointed and hired under the labor regime of Legislative Decree No. 276, Law No. 29944 and Law No. 30512.
It also includes university professors, health personnel, permanent and temporary workers in the public sector, personnel from the Armed Forces and the National Police of Peru; as well as pensioners in charge of the State included in the regimes of laws 15117, 19846, as well as decrees 20530 and 28091.
3. How much will the December Christmas bonus be?
According to Supreme Decree No. 283-2022-EF, which dictates regulatory provisions for the granting of the Christmas Bonus, establishes that the amount will be up to S/300. In the case of Human Medicine and Dentistry Interns, it is worth mentioning, the amount will be S/100.
2. When will the Christmas bonus be paid?
According to the norm that regulates the economic benefit, the Christmas bonus of up to S/300 will be included in the payroll corresponding to the month of December of the year 2022.
1. What are the requirements to receive the Christmas bonus?
Workers are entitled to receive the Christmas bonus, provided they jointly meet the following conditions:
- Be registered in the Computer Application for the Centralized Registry of Payrolls and Data of Human Resources in the Public Sector (AIRHSP)
- To have been working as of November 30, 2022, or using vacation leave, or paid leave, or receiving the subsidies referred to in Law No. 26790, Law on Modernization of Social Security in Health.
- Have been in the service for at least three months as of November 30 of this year. If you do not have that time, the payment will be made proportionally to the months and days worked.

5. What is gratuity?
The gratuity is the right of workers to receive additional remuneration for National Holidays, in the month of July, and Christmas, in December. The purpose of the bonus is that the worker can face the additional expenses that these festivities demand such as trips, excursions, purchases, among others, indicates the Ministry of Labor.
4. Which workers will receive the bonus in December?
To access the payment of the gratuity it is required:
- Be a worker in the private sector.
- They must be on the list.
- Have worked at least 1 month between July and December 2022.
3 How much will be paid in gratuity?
The payment is calculated according to the salary of each worker. Not everyone receives the same, but each person can receive up to more than one full salary.
The bonus will be the gross salary plus an additional 9% of the salary for Essalud, or 6.5% for EPS. In addition, it is calculated as follows: the worker will receive a proportional payment according to the months worked, this means 1/6 of the total amount for each month. If we talk about the payment for Christmas, it is counted from July to December.
2. When is the deadline for the payment of the bonus in December?
companies must deposit the gratuity until December 15, in accordance with article 5 of the Law on gratuities (Law 27735). It is estimated that more than 4 million workers on the payroll in the private sector receive the payment of this labor benefit.
1. What are the requirements to receive the bonus?
The worker must be on the payroll and have been working for at least one semester (from July to December) to receive the gratuity concept. In the case of the person who worked one month, the payment amount will be 1/6 of the computable remuneration for the month worked.
WHAT DO THE BONUS AND GRATIFICATION HAVE IN COMMON?
Both concepts for workers, in July and December, cannot be subject to discounts. Law No. 30334, which establishes measures to boost the economy in 2015, provided that bonuses and gratuities are not subject to contributions, contributions or discounts of any kind; except those other discounts established by law or authorized by the worker. Likewise, it established that its provisions were also applicable to retirees and pensioners, and provided for the indefinite validity of said provision.
