According to lawyers, Bolsonaro has permanent illnesses, which require “intense medical monitoring” and, for this reason, the former president must remain under house arrest.

The defense’s request aims to prevent Bolsonaro from being taken to the Papuda prison, in Brasília.

Sentenced to 27 years and three months in prison in the criminal action of Core 1 of the coup plot, Bolsonaro and the other defendants could have their sentences carried out in the coming weeks.

Last week, the First Panel of the Court rejected the so-called embargoes for clarification of the former president and six other defendants to reverse the convictions and avoid the execution of sentences in a closed regime.

Next Sunday (23), the deadline for the defenses to present the last appeals ends. If appeals are rejected, arrests will be carried out.

Risks

According to the defense, Bolsonaro’s return to prison will have “serious consequences” and represents a risk to the former president’s life.

The lawyers presented exams and said that Bolsonaro is in poor health and suffers from daily gastroesophageal hiccups, shortness of breath and uses medications that act on the central nervous system.

The health problems are a result of the stab wound against Bolsonaro in the 2018 election campaign, according to the defense.

“These are circumstances that, as we know, are absolutely incompatible with the common prison environment”, added the lawyers.

There is no deadline for Alexandre de Moraes to decide on the request for house arrest.
