Jair Bolsonaro’s defense asked the Federal Supreme Court (STF) this Monday (12) to shelve the investigation into jewelry received from foreign authorities during the former president’s government.
The lawyers’ request was made after the Federal Court of Auditors (TCU) decision on gifts received by former presidents. On Wednesday (7), the court understood that those present cannot be considered public goods.
For Bolsonaro’s defense, the TCU’s decision confirms that “there is no illegality in the conduct carried out” by the former president.
“The administrative decision that recognizes the lawfulness of the behavior — if it is free from defects and surrounded by legal formalities — directly interferes in the criminal sphere, because it eliminates the need for this last control, based on the principle of subsidiarity”, says the defense.
Last month, the Federal Police indicted the former president for money laundering and criminal association after closing the investigation against Bolsonaro and 11 other people, including former aide Mauro Cid.
The investigation found the operation of a criminal organization to divert and sell gifts from foreign authorities during the Bolsonaro government. The items were received during trips to Saudi Arabia.
During the investigations, the PF found that some of the jewelry left the country in a suitcase transported on the presidential plane and was sold in the United States.
