The draft presidential decree dated 2022 “was never published, nor was it going to be,” justified the defense of the far-right ex-president in a response sent to the electoral court on Thursday.
Bolsonaro’s defense argues that the document “is apocryphal, it never left the private residence of third parties, it was not published or publicized (…) it never went beyond the level of cogitation.”
The Supreme Electoral Tribunal of Brazil is investigating whether Jair Bolsonaro abused political power during the October presidential campaign.
The court had given Bolsonaro three days to explain the document that police found last week at the home of his former Justice Minister, Anderson Torres, during a search.
Bolsonaro, who for years sowed doubts about the Brazilian electoral system, was defeated by the leftist leader Luiz Inacio Lula da Silva by a 1.8% margin, and so far has not verbally acknowledged the triumph of its archrival.
The document found in the house of Torres, who is detained and under investigation for the assault on Brasilia on January 8, provided for federal control of the Supreme Electoral Tribunal, in charge of the elections.
It determined that its functions be assumed by a commission of 17 members, 8 of which, military.
The decree would have the objective of guaranteeing the preservation and immediate restoration of the transparency and correctness of the 2022 presidential electoral process.
The current Minister of Justice, Flavio Dino, said that the draft is “a link in the coup chain” and that it “shows the true purpose of the events of January 8.”
Bolsonaro, also under investigation for the violent invasion of the headquarters of public powers, traveled to the United States before the end of his term and the ceremony of transmission of command on January 1.
