Betssy Chávez: Congress debates on Wednesday the 19th her disqualification from holding public office for 10 years

The Plenary Session of the Congress of the Republic will debate and vote next Wednesday the 26th, starting at 3 in the afternoon, the final report of the constitutional complaint against the former prime minister of the Castilian government, Betssy Chavezfor his participation in the execution of actions prior to and after the coup d’état of December 7, 2022, which recommends his disqualification from holding public office for a period of 10 years.

The document — approved, by a large majority, on September 29 — specifies that Chávez Chino, in her capacity as former president of the Council of Ministers, incurred the alleged violation of articles 38, 39 and 45 of the Political Constitution of Peru, “during the unconstitutional and illegal coup d’état of December 2022.

Lady Camones, president of the Subcommittee on Constitutional Accusations, said on that occasion, during the report’s support, that the recommendation for disqualification from the exercise of public office arises as a “necessary consequence of the proven infraction and as a guarantee of the preservation of the democratic order and the supremacy of our Constitution.”

He added that the former chief of staff supported an act that was null and void from its origin, trusting that the force of her investiture was enough to impose it. “That decision turned his position into an instrument of the breakdown of the constitutional order and obliges Congress to impose an exemplary sanction to guarantee that an attempt to break the will of the people is never repeated,” he stressed then.

With the right to defense

Today, the president of Parliament, Fernando Rospigliosi, said that the Board of Directors scheduled the debate and vote on the final report for Wednesday the 19th. Chávez may attend the session accompanied by her lawyer to exercise her right to defense.

It should be noted, however, that this is the second constitutional complaint against Chávez for the 2022 coup d’état that is pending in Parliament. Precisely today, earlier, the Subcommittee on Constitutional Accusations approved the final report of the constitutional complaints presented by congressmen Alejandro Muñante and Alejandro Cavero, which also recommends disqualifying Chávez for 10 years along with former president Pedro Castillo and former Interior Minister Willy Huerta

On the other hand, when Rospigliosi was consulted about the request for preventive detention made by the Attorney General’s Office against the former premier, he commented that the measure is “theoretical” since the former parliamentarian is already asylum in the Mexican embassy.

“There is no way to capture her, that is not going to change the situation because the government of Mexico, we already know, is a left-wing government that supports dictatorships, that supports the Cuban dictatorship, which would have supported Pedro Castillo’s dictatorship if it had been installed,” he stressed, adding that it is now up to José Jerí’s government to make known what decision it makes regarding the request for safe passage for Chávez.
