The Minister of Culture, Betssy Chavezas a congressman (Democratic Peru), filed an accusation with the National Justice Board (JNJ) against the Nation’s prosecutor, Patricia Benavides, for the constitutional complaint filed against President Pedro Castillo.
Through a letter addressed to Jose Avila Herrera, president of the JNJ, Chávez requests that Benavides Vargas be removed from his position for an alleged serious infraction. In that sense, he proposed that the prosecutor be removed from the post as a provisional measure until the case process is over.
In her arguments, the minister alleges that the head of the Public Ministry, when filing the complaint against the president, made a tax proposal that contravenes the provisions of the Political Constitution of Peru.

“Mrs. Patricia Benavides Vargas, would be committing a serious offense since this malicious contravention of the Constitution and a jurisdictional resolution imports an undue interference in the exercise of the functions of another organ of the State, which is typified as an serious offense in subsection 6 of article 47 of the Prosecutor Career Law”, the document reads.
In that sense, Betssy Chavez pointed out that the complaint for alleged criminal organization, aggravated influence peddling and collusion would not fit into the crimes contemplated in article 117 of the Magna Cartawhere it is proscribed that the head of state can only be accused for four reasons.
Next, he asserted that the actions of the National Prosecutor “it shows a clear political intention”where the Code of Ethics of the Public Ministry would be ignored.
“I request that you act objectively and with the preponderant attention that a fault such as the one expressed deserves.which, as can be seen in the media itself, is not an isolated situation and unfortunately is not restricted to a situation of infringement with purely procedural effects (for the parties), but social and at the highest level”, indicated the member of the cabinet.
