BCV will appeal court ruling on Venezuelan gold deposited in England

Maduro’s BCV insists that the British Justice must respect the decisions of the TSJ and warned of the risk that Juan Guaidó, recognized by England as interim president, access national assets without any supervision


The board of the Central Bank of Venezuela (BCV), chaired by Calixto Ortega Sánchez, will appeal a court ruling from last July that granted the parallel of interim president Juan Guaidó, recognized as such by the international community, the authority over Venezuelan gold deposited in the Bank of England, as indicated this Tuesday, September 27, by the legal team of the administration of Nicolás Maduro.

Maduro’s BCV will present its arguments, on a date yet to be specified, before the London Court of Appeal, after receiving authorization to do so on September 12 from Judge Sara Cockerill.

This judge of the Commercial Division of the Superior Court, who issued the opinion of July 29authorized the appeal considering that, given the relevance of the case, it is interesting that a higher court analyze its conclusions, says the law firm Zaiwalla & Co, representative of Maduro’s side, in a statement.

After a four-day trial that ended on July 18, Cockerill decided that he could not accept the judgments of the Venezuelan Supreme Court of Justice (TSJ) that annulled Guaidó’s appointments to his “ad hoc” board of the Central Bank of Venezuela , finding no legal basis in the UK to do so.

On the other hand, Maduro’s BCV insists that the British Justice must respect the decisions of the TSJ and warned of the risk that the opposition leader accesses national assets without any type of supervision.

According to the statement issued today, on September 21, Judge Cockerill rejected the request of Guaidó’s side to grant them an order that allows them material access to the reserves, considering that at the moment there are not enough guarantees of good management.

The British Supreme Court has already established that the Government of London only recognizes Guaidó, and not Maduro, as president of Venezuela (on an interim basis until democratic elections are held) and that, therefore, his acts and decisions must be considered sovereign .

However, the aforementioned point remains to be clarified as to whether the English courts should accept the sentences of the Venezuelan Justice that invalidate the decisions of the opposition leader, whom London sees as the only legitimate leader of the Latin American country.
