The document was prepared by the forensic ballistics expert from the Public Ministry’s Expertise Office, Walter Cubas, at the request of the provincial prosecutor of the Third Supranational Criminal Prosecutor’s Office Specialized in Human Rights and Interculturality, Roger Yana Yanqui.

According to the minutes, at 3:14 in the morning on October 16, knowledge was learned that the body of Eduardo Mauricio Ruiz San had been admitted to the mortuary of the Archbishop Loayza Hospitalwhere the preliminary examination of the body was carried out. Likewise, by fiscal provision, at 8:50 am the Forensic Thanatology Unit of the Prosecutor’s Office (Lima Central Morgue) in order to participate in the autopsy procedure.
Four days later, on October 20 at 9 in the morning, the ballistic examination was carried out. The yellow manila envelope where it was kept days before was opened.
According to the report, the projectile has the following characteristics: approximate size of 9 mm, made of lead material, deformed and with loss of material. It has a length of 23 mm, a width of 11 mm and a height of 5.5 mm with a weight of 4.84 grams.

Criminalistics assessment
The report gave more details about the bullet impact that ended the life of Eduardo Ruiz. According to the document, it is a projectile from a firearm, a short weapon. The lead projectile is a malleable material that tends to “deform and fracture.”
The characteristic of the entrance hole of the corpse examined is ovoid, elongated, with irregular edges. However, the analysis indicated that “this is not a typical conventional shot of a caliber bullet of approximately 9 mm, which should replicate a circular shape similar to the diameter left by a fired bullet.”
The report indicates that, upon impact on a hard and resistant surface such as a street track, the bullet fragmented “impacting only part of the core.”
Furthermore, it highlights that the trajectory of the shot, with entry from bottom to top into Ruiz Sanz’s body, “must be corroborated in the context of the place with video viewing, statements from witnesses or defendants in order to reconstructively establish the shape of the shot.”
Eduardo Ruiz’s lawyer speaks out after ballistics report
In dialogue with The Republicthe lawyer of Eduardo RuizRodrigo Noblecilla, assured that, until now, they have not been notified of the ballistics report carried out by the Public Ministry and described said document as “null” because for Ruiz’s defense the shot was fired “diagonally”, while for the non-commissioned officer’s lawyers Luis Magellan as a “rebound shot.”
“There was not only one shot as the man says, he fired 3 shots, with the last one causing death. There are videos of that,” he said.
However, Noblecilla denounced that the prosecutor in charge of the case has reclassified the accusation against non-commissioned officer Magallanes. The preliminary investigation, the lawyer maintained, began as a qualified homicide in the context of serious human rights violations (with a sentence of up to 15 years in prison); However, now they present it as a simple homicide. When asked if this ballistics report would have the objective of removing responsibility from Magallanes, the lawyer agreed.
“The guy (the prosecutor) is rectifying himself and is listening to Arriola so that (the case) goes to a common prosecutor’s office. A ballistics report that leaves a lot to be desired, they put little else there that he should not go to jail, it is not an objective ballistics report. They do not mention the people in the ICU and the more than 100 injured in the exercise of the right to protest,” he declared.

“As the case is due to human rights violations, it allows us to avoid the statute of limitations, amnesties, prison benefits,” he said.
