Avelino Guillénformer prosecutor who investigated the deceased Alberto Fujimori, assured that the laws that Congress and the Executive have been promoting against crimethey are nothing more than “demagogic and populist measures“, with which they would seek to deceive public opinion that they are working, when in itself, it is the Government that has been giving more benefits to criminals. “I did not imagine that it could reach these levels,” he expressed.
In an interview for the Ojo Público portal, Guillén compared the current Government of Dina Boluarte with the regime of the 90s of Alberto Fujimori, highlighting that the Executive seeks to give impunity to the military and police through the bill against urban terrorism, threatens the free protest of citizens and also tries to limit fiscal work during investigations of senior state officials.
The consequences of the law against organized crime
According to the former prosecutor, Law 32108, which has generated changes to organized crime, has only managed to exclude crimes under six years of age, including extortion, the main crime that has been affecting dozens of businesses, transportation and enterprises.
“It begins with the deactivation of the police team that supported the Public Ministry in the investigations of the special team led by prosecutor Barreto. They initiated a very important investigation against Nicanor Boluarte for the ‘Los Waykis en lashadow’ case. The solution
For Guillén the solution is, first of all, to repeal Law 32108, an opinion that is shared by the Lima Bar Association. Next, purge the National Police of Peru. “The Police are not in a position to pursue crime if they have many members who are questioned by serious cases of corruption and police abuse (…). What has to be done is to optimize the role of the State to combat crime, repeal all these regulations,” he said.
Likewise, he once again specified that if the regulations against urban terrorism are approved, it would cause any person who protests to be classified as a “terrorist.” Along these lines, he referred to the Executive’s proposal, in which it seeks that the Army and the PNP be judged by military jurisdiction: “Homicide, torture, abuse of authority, mistreatment, these are not military legal rights. “These are common crimes. Regardless of whether the aggressor is a civilian or a soldier or a police officer, he must still respond to justice. The fact that he is a soldier or a police officer does not exonerate him from his responsibility for the crime he has committed.”
